Will My Divorce Involve an Alimony Ruling?

Alimony, or “spousal support,” is not a right like child support. It is generally based on the financial need of one spouse and the other spouse’s ability to meet that need. 

The court considers each spouse’s income and reasonable expenses when making spousal support determinations.

According to Tennessee Code Annotated 36-5-121, spousal support rulings are based on:

  • The length of the marriage
  • The physical condition of each spouse
  • The standard of living during the marriage
  • The relative education level of each spouse 
  • Whether someone is at fault in the marriage
  • The age and mental condition of each spouse
  • The comparative earning capacity of each spouse
  • The primary roles each spouse played during the marriage
  • The existence of martial and separate property and how it is divided in the divorce

Types of Alimony in TN

The state can order various types of alimony. 

Rehabilitative alimony allows the receiving party to seek additional training or education. This will help them become independent, so they can earn a wage that gives them a comparable standard of living.

Transitional alimony helps the receiving spouse adjust to singledom and the economic obligations accompanying their new life. 

Alimony in futuro is long-term alimony. Many consider this “permanent” alimony. Courts order these payments when the receiving spouse cannot earn a wage or maintain their standard of living. 

Alimony in solido is a lump sum used as long-term alimony. The payor is given a deadline and must make the payment all at once. 

Courts decide which is appropriate based on:

  • The length of the marriage
  • The receiving spouse’s need
  • The receiving spouse’s ability to maintain their standard of living
